How does the mediation process work ?
Mediation allows for creative outcomes that would not be available through the narrower remit of investigation or litigation.
Request for Mediation
The process typically starts with a request for mediation from one or both parties involved in the conflict.
Understand the issues
The mediator then meets separately with each party to understand their perspective on the issue(s).
Finding a solution
The mediator may then bring both parties together where they can share their concerns and work towards finding a mutually acceptable solution.
Agreement document
Where agreement is reached on a resolution - the mediator will produce a document capturing what was agreed for both parties to sign.
This meeting is very much about fact finding in terms of the nature of the dispute and a brief background around why mediation is now an option for you / your colleagues.
I will then be able to outline if I can assist and detail my suggested approach and indicative costs.

If you decide that you would like me to provide mediation, I will prepare and issue an Agreement to Mediate which will detail all elements of how your mediation will work and payment of fees and is signed by all parties to the mediation. My mediation practise is informed and guided by the Mediators' Institute of Ireland Code of Ethics and Practice
Based on the details you provide me with, I will contact the parties participating in the mediation and seek their agreement to engage with me and if so, agree dates, times and location (in person, via telephone or videoconferencing) to have the first individual meetings.
If a resolution is agreed and achieved I will produce a written agreement for all parties involved in the mediation, reflecting the terms of the agreement. This will then conclude my involvement.
At any time should a party withdraw from mediation or I do not believe a resolution will be achieved at this time, I will advise and this will conclude my involvement.

The Act came into force on 1st January 2018 and established a statutory framework designed to promote the resolution of disputes through mediation as a viable, efficient and cost-effective alternative to court proceedings.
Various published statistics suggest the mediation process enjoys a 65% to 80% success rate.
The ICMA announced findings from a survey which issued to the Managing Partners of more than 3,500 Law and Accountancy firms as well as Barristers and other professionals. The respondents said that the key advantage of commercial mediation is cost saving, stating that their clients could save up to 70% compared with litigation
The Financial Services & Pension Ombudsman (FSPO) 2019 published figures show that of the 1,399 complainants who received redress and/or compensation 983 of these were resolved through mediation.
However, each dispute or conflict is unique and I am unable to guarantee or make any claim as to the outcome of any mediation case I manage.
